Terms of Service

1. The service

MepMail lets you send transactional email through an HTTPS API, an SMTP relay, or an MCP server, and to manage sending domains, contacts, suppressions and delivery events. Email is delivered through Amazon SES, which acts as our delivery infrastructure.

The service is offered in tiers with monthly send volumes. You are responsible for choosing the tier that fits your volume; exceeding it moves sends to overage billing as described on the pricing page.

2. Your account

You must provide accurate account information, keep your credentials and API keys secret, and be at least 18 years old (or the age of majority where you live). You are responsible for all activity under your account and for the content you send.

You must have a lawful basis to email the recipients you upload or send to — typically their consent or an existing customer relationship.

3. Acceptable use

MepMail is for permission-based transactional and marketing email. You must not use the service to:

• Send unsolicited bulk email (spam) or email to purchased, rented or scraped lists.
• Send phishing, malware, fraudulent or deceptive messages, or spoof sender identity.
• Send content that is illegal, harassing, hateful or infringing.
• Process data you do not have the right to process.
• Probe, overload or attempt to bypass the service's limits, quotas or security.

4. Spam complaints and reputation

Email deliverability depends on sender reputation. If your sending generates spam complaints, bounces or blocklist listings, we may pause sending, require changes, or suspend the account. In severe cases we may terminate immediately without refund, as described in the Refund Policy.

5. Plans, billing and overage

Paid plans are billed in US dollars through Stripe, monthly, in advance. Volume is counted per distinct recipient, like our delivery infrastructure does. Sends beyond your plan's included volume are billed at the plan's overage rate, and can be capped from the dashboard.

If a payment fails, we may suspend sending until it is settled. Prices may change with at least 30 days' notice; changes never apply retroactively to a period you already paid.

6. Cancellation

You can cancel at any time from the dashboard. Cancellation stops future renewals; the account remains active until the end of the paid period and then moves to the free tier with its sending limits. Refunds are covered by the Refund Policy.

7. Availability and delivery

We aim for high availability, but during the open beta the service is provided "as is", without a guaranteed SLA. We may perform maintenance and may change or discontinue features.

We cannot guarantee that any individual email will be accepted, delivered or read: recipient servers, filters and blocklists are outside our control. Our delivery infrastructure's event data is the reference for what happened to a message.

8. Suspension and termination

We may suspend or terminate your account if you violate these terms, if required by law, or to protect the service or other customers. You may delete your account at any time. Sections that by their nature should survive termination (billing, liability, governing law) survive.

9. Intellectual property

The MepMail software is open source under the AGPL and can be self-hosted; the hosted service, brand and documentation are ours. Your data — contacts, messages and domains — remains yours. We claim no ownership over it.

10. Liability

To the maximum extent permitted by law, our total liability for claims related to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, lost profits, or the content sent through the service. Nothing here excludes liability that cannot be excluded by law.

11. Changes to these terms

We may update these terms. Material changes are announced by email or on this page at least 15 days before they take effect. Continuing to use the service after the effective date means you accept the new terms.

12. Governing law

These terms are governed by the laws of Brazil, where the service is operated. Disputes are settled in the courts of Paranavaí, Paraná, Brazil, unless mandatory consumer law in your country provides otherwise.
